Terms of Service
The short version. SpellingJoy Reading is a subscription for parents of children aged 4 to 8. You get 7 days free; after that we charge the plan you chose to the card you gave us until you cancel: $19.90 a month, or $199 once a year. You can cancel any time from your account and keep access until the end of the period you paid for. Payments are not refunded. You must be an adult, and you are responsible for your child's use. We are not a school and make no promise about results. Disputes go to individual arbitration. The full terms are below and they are the ones that count.
1. Who we are and what these Terms cover
These Terms of Service (the "Terms") are a binding agreement between you and Veloris, LLC, a Delaware limited liability company doing business as SpellingJoy ("SpellingJoy", "we", "us"). They cover the website at reading.spellingjoy.com, the SpellingJoy Reading application, its lessons, stories, characters, voices and pictures, the parents area, and every email we send about them (together, the "Service"). By creating an account, starting a trial, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is separate from the SpellingJoy website at spellingjoy.com and its teacher and homeschool products, which have their own terms. Only these Terms apply to SpellingJoy Reading.
2. Who may use the Service
- Parents and guardians only. You must be at least 18 years old and the parent or legal guardian of every child you add. By adding a child you confirm that you are that child's parent or guardian and that you consent to the child's use of the Service under your supervision.
- Children use it through you. A child never creates an account, never gives us an email or a payment method, and never sees a price. Everything that concerns money or settings sits behind a parental gate that asks for a year of birth. You are responsible for keeping that gate between your child and those screens.
- One child per account. Each account carries one child profile. To add a second child, create a second account.
- Accurate information. The email you give must be yours and current; the child's first name and age must be truthful, because the lessons and the parent reports depend on them.
- Where you live. The Service is offered from the United States in English. You may use it from elsewhere, but you are responsible for complying with your local law.
3. Your account
You sign in with a one-time code sent to your email or with Google. There is no password to keep, so keep your email account safe: anyone who can read your email can open your SpellingJoy Reading account. Tell us at once at reading@spellingjoy.com if you believe someone else is using your account. You are responsible for everything done through it.
4. The free trial
- New accounts get a free trial of 7 days from the moment you start it. A payment method is required to start the trial; nothing is charged during the trial.
- The trial converts automatically. When the 7 days end, we charge the plan you chose when you started the trial, $19.90 for a month or $199 for a year, to your payment method, and your subscription begins, unless you cancelled before the trial ended. We email you a reminder two days before the trial ends.
- One trial per person and per household. We may refuse a trial to an account that appears to repeat one.
- Accounts we marked as founders (accounts created before the subscription existed) keep free access for as long as we offer it; we may change that with 30 days' notice by email.
5. Subscription, billing and price changes
- Recurring charge. The subscription is $19.90 per month, or $199 per year, which is 2 months free against the monthly price (US dollars, taxes may be added where the law requires). It renews automatically, on the same day each month or each year, until you cancel. You choose the plan when you start the trial and can switch from Manage billing; a switch takes effect at the next renewal.
- Payment processing. Payments are handled by Stripe. We never see or store your full card number. By giving a payment method you authorise us and Stripe to charge it for each renewal.
- Failed payments. If a charge fails we retry and email you. If it still fails, access ends until the payment goes through. Nothing you or your child earned is deleted for a failed payment.
- Price changes. We may change the price. We will email you at least 30 days before a new price applies to your account. Continuing after that date means you accept the new price; otherwise, cancel before it.
- Statement descriptor. Charges appear on your statement as SpellingJoy Reading or Veloris LLC.
6. Cancelling
You can cancel at any time, in one place: open the parents area (For parents, then your year of birth), choose Manage billing, and choose Cancel. You can also email reading@spellingjoy.com from the account's email address and we will cancel for you within two business days. Cancelling stops future charges; your access continues until the end of the period you already paid for, or the end of the trial, and then closes. Your child's progress stays for 12 months so you can come back.
7. No refunds
Except where a refund is required by law that cannot be waived, all payments are final and non-refundable, including for partial months, unused time, and time after you cancel. The free trial exists so you can decide before paying anything. If you believe a charge is a mistake, write to us before disputing it with your bank; we answer every email.
8. What you get, and what we do not promise
The Service teaches early reading through phonics lessons, stories and games, in the same sequence as a published scope and sequence (UFLI Foundations). SpellingJoy Reading is independent: UFLI and UFLI Foundations are trademarks of the University of Florida, and we are not affiliated with, endorsed by, or certified by the University of Florida or the UFLI team. It is a practice tool for families. It is not a school, a curriculum provider, a diagnostic tool, or a substitute for a teacher or a reading specialist, and we make no promise that any child will reach a particular reading level or result. The parents area shows what your child did in the app; it is not an assessment of your child. If you are worried about your child's reading, speak with their teacher or a qualified professional.
We change the Service often: we add and remove lessons, characters, items and features, and we may pause or end parts of it. Where a change removes something you paid for in the current period, you may cancel and we will refund the remaining days of that period on request.
9. Acceptable use
You agree not to: share your account or let anyone but your own child use it; copy, record, scrape, resell or redistribute lessons, stories, pictures, voices or characters; reverse engineer the Service or interfere with its operation; use automated tools to access it; use it to build a competing product; or use it in any way that breaks the law or harms a child. We may suspend or close accounts that do.
10. Our content and your data
Everything in the Service (the lessons, the stories, Joy's voice, the buddies, the pictures, the code and the design) belongs to Veloris, LLC or its licensors and is protected by copyright and trademark law. You get a personal, non-transferable licence to use it with your child for as long as your account is active, and nothing more. "SpellingJoy" and the buddy characters are our marks.
The information we hold about you and your child, and how we use it, is described in the Privacy Policy, which is part of these Terms. You can delete your account and your child's data yourself from the parents area at any time.
11. Ending the agreement
You may end it by deleting your account. We may suspend or end your access if you break these Terms, if a payment fails and is not fixed, or if we discontinue the Service; in the last case we will tell you by email at least 30 days ahead and refund any prepaid days after the closing date. Sections 7, 10, 12, 13, 14 and 15 survive the end of the agreement.
12. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and that the Service will be uninterrupted, error-free or produce any educational outcome. Some jurisdictions do not allow these exclusions, so some may not apply to you.
13. Limitation of liability
To the fullest extent the law allows, Veloris, LLC and its owners, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or the cost of substitute services, arising from or related to the Service or these Terms, however caused. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or one hundred US dollars, whichever is greater. These limits apply even if a remedy fails of its essential purpose. Nothing here limits liability that cannot be limited by law.
14. Indemnity
You will defend and hold harmless Veloris, LLC from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your use of the Service in violation of law, or your child's use of the Service under your account.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law rules. Please read this section carefully: it affects your rights.
- Talk to us first. Before starting any formal proceeding, email reading@spellingjoy.com with a description of the problem and give us 30 days to resolve it. Most problems are solved this way.
- Binding arbitration. Any dispute that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitrator may award the same relief a court could, to you individually.
- No class actions. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated or representative proceeding.
- Opt out. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms, stating that you opt out. Then disputes go to the state or federal courts in Delaware, and you consent to their jurisdiction.
16. Changes to these Terms
We may update these Terms. For material changes we will email the address on your account at least 14 days before they take effect and show the new date at the top of this page. Using the Service after the effective date means you accept the change; if you do not, cancel before it.
17. Other things
These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a part is found unenforceable, the rest stands. Our not enforcing a provision is not a waiver of it. You may not transfer this agreement; we may transfer it to a successor of the business. Notices to you go to your account email; notices to us go to reading@spellingjoy.com or to Veloris, LLC, attention SpellingJoy Reading, at the address on our website.
